Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you (“Client”, “you”) and Acconvo (“we”, “us”, “our”) governing your access to and use of the Acconvo platform and all associated services.

By signing up, connecting a CRM, or otherwise using Acconvo, you confirm that you have read, understood, and agree to these Terms. If you are using Acconvo on behalf of a company, you represent that you have authority to bind that company.

2. The Service

Acconvo is a revenue automation platform that:

  • Connects to your CRM (HubSpot or Zoho) via webhook and API
  • Scores and qualifies inbound leads based on your configuration
  • Sends personalised email and WhatsApp messages on your behalf
  • Reads and classifies lead replies using AI
  • Makes automation decisions (continue, escalate, pause, revive) based on those signals
  • Logs every action back to your CRM and provides a client dashboard

We reserve the right to modify, update, or discontinue features at any time. We will give reasonable notice of material changes that affect existing functionality.

3. Account & Access

You are responsible for maintaining the security of your account credentials. You must not share login access with unauthorised parties. You must notify us immediately at krishan@acconvo.com if you suspect unauthorised access.

We may suspend or terminate your account if we detect misuse, abuse, or violation of these Terms.

4. CRM & Inbox Permissions

By connecting your HubSpot or Zoho CRM, you grant Acconvo permission to:

  • Read contact and lead records triggered by webhooks you configure
  • Create and update contact properties, notes, and tasks
  • Read engagement data associated with contacts

By connecting a Gmail inbox, you grant Acconvo permission to:

  • Send emails on behalf of the connected address
  • Read incoming emails to that address for lead reply handling
  • Manage Gmail watch subscriptions (Push Notifications)

You can revoke these permissions at any time from your Google account settings or your Acconvo dashboard. Revoking access will stop automation for leads assigned to that inbox.

5. Your Data & Lead Data

You retain full ownership of all data you bring into Acconvo — including CRM data, lead contact information, email content, and knowledge base entries.

You represent and warrant that:

  • You have a lawful basis under applicable law (GDPR, DPDP 2023, or equivalent) to process the personal data of leads you pass to Acconvo
  • The leads have not opted out of receiving commercial communications
  • You will not use Acconvo to send spam, illegal content, or messages that violate the terms of connected platforms (Gmail, WhatsApp, HubSpot)

Acconvo processes lead data as your data processor. Our handling of that data is governed by our Privacy Policy.

6. AI-Generated Content

Acconvo uses AI to generate email and WhatsApp message drafts, classify lead intent, and produce conversation summaries. You acknowledge that:

  • AI-generated content is based on your knowledge base and may not always be accurate or appropriate
  • You are responsible for the content sent to leads from your inbox and CRM, regardless of whether it was AI-generated
  • Acconvo is not liable for any outcome arising from AI-generated messages sent to your leads

We strongly recommend reviewing your knowledge base regularly to ensure the AI has accurate, up-to-date information to work with.

7. Acceptable Use

You agree not to use Acconvo to:

  • Send unsolicited bulk messages (spam) or violate anti-spam laws
  • Process data of individuals who have not consented to commercial contact where required by law
  • Engage in deceptive, fraudulent, or misleading communications
  • Transmit malware, viruses, or any harmful code
  • Attempt to reverse engineer, scrape, or extract the underlying platform code or models
  • Circumvent usage limits or access controls
  • Use the platform for any illegal purpose

We may terminate your account without notice for serious violations of this section.

8. Subscription & Payment

Acconvo is offered on a subscription basis. The specific plan, price, and billing cycle are agreed at the time of signup.

  • Subscriptions are billed monthly or annually in advance
  • Prices are in INR unless otherwise stated
  • Fees are non-refundable except where required by law
  • Failure to pay may result in service suspension after 7 days' notice
  • We reserve the right to adjust pricing with 30 days' notice to existing clients

9. Service Levels & Support

We aim to maintain platform availability of 99% on a monthly basis, excluding scheduled maintenance. We do not currently offer a formal SLA except on the Scale plan.

Support is available via email at krishan@acconvo.com. Response times are typically within 2 business hours during IST working hours (Mon–Fri, 10am–7pm).

10. Termination

By you: You may cancel your subscription at any time from your dashboard or by emailing krishan@acconvo.com. Cancellation takes effect at the end of the current billing period. No refund is issued for unused time.

By us:We may suspend or terminate your account immediately if you breach these Terms, abuse the platform, or fail to pay after notice. We may also terminate with 30 days' notice for any reason.

On termination, your data will be retained for 90 days then permanently deleted, in line with our Privacy Policy. You may request an export before that window closes.

11. Intellectual Property

Acconvo and all associated software, models, designs, and documentation are owned by Acconvo. Nothing in these Terms transfers any intellectual property rights to you.

You grant Acconvo a limited licence to process, store, and transmit your data solely to deliver the service. This licence ends when your data is deleted.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Acconvo is provided “as is” without warranties of any kind, express or implied
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • Our total cumulative liability to you in any 12-month period shall not exceed the total fees you paid to us in that period
  • We are not liable for losses arising from third-party platform outages (HubSpot, Gmail, WhatsApp, OpenAI)
  • We are not liable for outcomes of AI-generated messages sent to your leads

Some jurisdictions do not allow limitation of liability — in those cases, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold Acconvo harmless from any claims, losses, or damages (including legal fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your processing of lead data without proper consent; or (d) content you provide to the platform.

14. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Delhi, India.

Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at krishan@acconvo.com and giving us 30 days to respond.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of Acconvo after that date constitutes acceptance of the updated Terms.
